Describe about the Corporate Law.
Answer:
The destruction of the olive groves by the Ridgeley’s pilot can be sued in the court of law. Oleocampo Company that is owned by George Michael has the right to sue Andrew Ridgeley for his negligence. Moreover, Ridgeley would have shown his new pilot where the farm is exactly during the period of spraying the chemical pesticides. However, the pilot undertook the duty while he was alone without anyone to guide him. The individual was new to the place and was not familiar with the location and the boundaries of the two farms. The pilot mistakes the olive groves to be Andrew’s farm as their bounder each other. The chemical pesticide causes a massive destruction of the crops and Michael is forced to discontinue supplying the olive oil to his customers. If it were not for Ridgeley negligence to show the new pilot the correct location of the farm, the crops would not have been destroyed. It was the duty of Andrew to give orientation to the new pilot on the site of the farm. Moreover, he was also to instruct him to be careful while spraying the farm not to tamper with the neighboring farm. The neglect of providing the instructions and giving orientation led to the destruction of the olive groves of Oleocampo Company. The matter is chargeable in a court of law as it happened due to the negligence of Ridgeley. It led to significant losses for one year as there was no supply to the customers (Hill & McDonnell, 2012).
On the other hand, it forced the Oleocampo Company to lay off twenty-five percent of its staff due to the lack of enough funds to stabilize the organization. Most of the workers lost their jobs as there was no adequate salary to pay them. Julie was among the team that lost their jobs when the crops were sprayed with the chemical pesticide. It was painful as she had no money to repay her mortgage and also for her basic needs. However, if Ridgeley were successfully sued by the Julie, she would also be successful. It is because the Ridgeley would be forced to compensate the losses incurred and the mental distress that he caused due to his negligence. Julie, after she is compensated, will get back her job and repay the mortgage (Bainbridge, 2015). The funds will be utilized to cover the damaged crops and also reinstate the laid-off employees to continue working. The court of law requires one to be compensated for the mental distress that is caused due to an individual’s misconduct. Julie was unable to meet her repayments after she lost her job when the layoff occurred after the olive groves were destroyed. The issue affected her mentally as she had no other source of income to enable her to continue repaying the mortgage. Moreover, all the problems were caused by Ridgeley neglect to show the new pilot where exact the farm was and also instruct him on how to spray the farm. If it was not for the chemical pesticide, Julie would still be performing her duties at the company and earning her salary as usual. She can successfully sue Ridgeley and get compensated the suffering she has suffered (Bevans, 2007).
In addition to that, Maggie the wife of Wyatt Marlston, a celebrity chef suffered trauma after her husband got a heart attack due to Oleocampo lack of supplying the olive oil for a year. Wyatt Marlston had been using the olive oil for a long time while performing his usual television cooking shows. He was one of the major Oleocampo’s customers who had used the olive oil to perfect their career. Wyatt heart attack was caused by the lack of the Oleocampo discontinued the supply of the olive oil for one year. The television cooking shows were the source of income for Wyatt and his family depended on it for it needs. Marlston was rushed to the Royal Adelaide Hospital and admitted in the Intensive Care Unit. All these problems were facilitated by the Ridgeley negligence to give the new pilot the set of instructions and orientation that was appropriate. The admission of Wyatt also made the wife. Maggie suffers from trauma. Maggie has the right sue Ridgeley for his negligence and also the mental distress that his actions have caused. The federal court would help her get compensated by Ridgeley if she decided to sue him for his actions (Bainbridge, 2015).
However, for Maggie to get compensation she must prove that his husband was indeed a customer of the Oleocampo Company. The contracts forms that were signed by her husband and the company should be presented at the court of law. It will give substantial evidence to the federal court for them to believe he was a customer. The documents will enable the court to follow up the case and ensure she gets compensated. Moreover, her compensation would be indirect and would be done because of her husband engagement with the Oleocampo Company. There is a likelihood of her obtaining compensation as her husband was affected due to the Ridgeley’s negligence (Macmillan, 2003). On the other hand, she was also affected and suffered trauma as a result of her husband being admitted to the Intensive Care Unit. Maggie will successfully get compensated for the mental distress caused and that of her husband. The funds obtained will ease the mental stress caused and also pay the hospital bills. The neglect of Ridgeley is easily seen, and the court of law will automatically impose a penalty on him. The initiative will help set an example for other individuals who have the motive of neglecting their duties. It was the duty of Ridgeley to ensure that his crops were the only ones sprayed and no other neighboring farms. The new pilot never knew the area well, and he ended up causing massive destruction on the plants that were owned by Oleocampo Company. The pesticide was harmful to the other crops as they never required it for their growth and they were in the process of being harvested (Tomasic et al, 2002).
